2. Description of Service
BoostImage provides image processing services, including compression, conversion, resizing, and AI upscaling via a Web Interface and API.
3. User Accounts
- You are responsible for maintaining the confidentiality of your account and password.
- You are responsible for all activities that occur under your account.
- We reserve the right to terminate accounts that violate these Terms or use the Service for illegal activities.
4. Acceptable Use & Prohibited Content
You agree strictly NOT to upload, process, or distribute:
- Child Sexual Abuse Material (CSAM): We have a zero-tolerance policy. Any detection of such content will result in immediate account termination and reporting to relevant authorities.
- Illegal Content: Content that promotes terrorism, violence, or illegal acts.
- Malware: Files containing viruses, trojans, or malicious code.
You retain full ownership of the content you upload. By uploading, you grant us a temporary license to process and display the content solely for the purpose of providing the Service to you.
5. Payments and Refunds (Crypto Only)
5.1. Payment Method
We accept payments in USDT (BEP20) on the Binance Smart Chain (BSC).
5.2. User Responsibility
- You are solely responsible for sending the correct cryptocurrency to the correct address on the correct network (BSC).
- Sending funds to the wrong address or network will result in permanent loss. We cannot recover lost funds.
5.3. No Refunds
Due to the irreversible nature of cryptocurrency transactions and the digital nature of our Service:
- All sales are final.
- No refunds will be issued for completed transactions.
- If a transaction fails or is stuck in the blockchain, it is outside our control.
- Subscriptions are activated only after the transaction is confirmed on the blockchain.
6. Service Availability & Limitations
- No Warranty: The Service is provided "AS IS" and "AS AVAILABLE". We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.
- Data Loss: While we strive to keep your data safe during the retention period, we are not responsible for any loss of data. You should always keep backups of your original files.
- Maintenance: We may temporarily suspend the Service for maintenance or upgrades.
7. API Usage
- Rate Limits: You agree not to exceed the rate limits applicable to your plan.
- Abuse: We reserve the right to block API keys that abuse the Service (e.g., DDoS attacks, scraping).
8. Limitation of Liability
To the maximum extent permitted by law, BoostImage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator is based, without regard to its conflict of law provisions.
